Draft Planning Schemes

Draft West Tamar Planning Scheme

When first submitted to the Commission, the draft scheme was found not suitable for certification.

A replacement draft scheme was received on 20 June 2006 and certified on 9 October 2006 for public exhibition.

The public exhibition period ended on 11 December 2006 and the Council's report pursuant to Section 26 of the Land Use Planning and Approvals Act 1993 was provided to the Commission on 30 April 2007.   

The hearing was held on a number of days during November 2007 and the delegates decision is expected shortly. 

Draft Tasman Planning Scheme

The draft planning scheme was lodged with the Commission on 20 July.  At its meeting on 24 September 2007 the Commission resolved that the draft planning scheme was not suitable for certification for the following reasons:

  • the draft Planning Scheme has not been informed by a comprehensive analysis of land use and has not been predicated upon a quantitative review of land use supply or demand across various use classifications;
  • the draft Planning Scheme does not depict a clear settlement strategy for the development of residential settlements;
  • the draft Planning Scheme does not address the critical issues raised by Council in the background material supplied to date, and in some aspects is inconsistent with the draft Strategic Objectives identified by Council;
  • the draft planning Scheme has not been prepared in accordancce with State Policies and does not further the Objectives contained in Schedule 1 of the Act;
  • the draft Planning Scheme proposes zoning that are entirely inconsistent with recent decisions made by the Commission, and the material submitted to date does not address issues raised by the Commission when those decisions were made;
  • the material submitted to date does not demonstrate that the draft Planning Scheme has been prepared with the benefit of any consultation with relevant agencies, authorities or adjoining Councils, particularly in regard to s.21 of the Land Use Planning and Approvals Act 1993; and
  • the material submitted to date does not address the matters outlined in the Commission's Planning Advisory Note (PAN) entitled Supporting Information for Planning Schemes in a comprehensive manner.

Council was given notice to provide a revised draft planning scheme to the Commission within six months, and that period has now been extended for a further period, expiring on 9 December 2008.
